American Express not going to help with your online gambling

During the course of 2006, the Bush Administration passed the UIGEA legislation which stated that no games of chance were allowed to be played online. This meant that all forms of online gambling were to be excluded except for state lotteries and horse racing. It is not clear why these exceptions were made, but what is clear after more than three years with this law is the fact that it was very badly drafted and seemed to show that the lawmakers responsible for it were actually regarded as lazy because they did not follow due process. With all of this in mind, it is perhaps no wonder that the existing online gambling legislation in the United States continues to be questioned.

Another aspect of the law is the fact that financial services institutions such as banks and credit card associations are not allowed to process any transactions that are related to online gambling in any way. The online gambling industry has not had many problems, as there are always payment processors governed in other duristictions who process the transactions flawlessly.

When a court in the United States ruled that poker is a game of skill, interest groups immediately said that this meant that the game was legal in terms of the online gambling legislation and that it could be played. Naturally there were many enthusiastic people who decided to try their luck and there were various payment processors that were willing to help them out, but this was not what the Department of Justice wanted and there is now a matter that is to be brought before the courts.

It would seem that American Express does not want to take any chances and the company is one of a few that has decided it is not going to process any online gambling transactions until there is a clear statement by the United States government on the issue. At the moment the uncertainty means that the company could have a reputation problem if it were to simply go ahead and process transactions of this nature. It is clear that the matter has to be resolved as soon as possible because right now there are too many people that really don’t know what is going on and they need to be assured of what their rights and obligations are in terms of online gambling.
